Agreement
By accessing or using Burning Ash Protocol ("BAP", "Service"), operated by TripleVision LLC, available at www.baprotocol.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part, do not use our Service.
Service Description
BAP is a digital notification and file delivery system that enables users to:
- Upload and encrypt important documents and messages
- Designate recipients who can receive those documents/messages
- Configure automated liveness checks
- Enable secure document and message transfer upon death or incapacitation
⚠️ IMPORTANT: Not a Legal Will Service
BAP is a messaging and file delivery platform — NOT a legal will service.
Many countries and jurisdictions do NOT legally recognize digital wills. BAP does NOT produce legally binding wills. We are a system to notify your designated recipients about the location of your important documents or messages — we do not create or validate legal documents.
You must ensure the proper validity of any will or legal document by consulting a qualified legal professional in your jurisdiction.

We do not:
- Provide legal advice
- Validate wills
- Ensure legal compliance
- Act as executor
- Guarantee that your documents will be recognized as legally binding
Consult a qualified attorney for all legal matters.
No Guarantee of Action by Recipients
We do NOT guarantee that your recipients will act upon any instructions, documents, or messages you send through BAP.
The system may be used to deliver instructions, but we assume no responsibility for whether recipients follow those instructions.
Key Recovery Not Possible
We cannot recover encryption keys.
If you or your recipients lose:
- Access to authentication
- SSS backup codes
Your data becomes unrecoverable.
This is by design for security. We cannot bypass this.
Service Provided "AS IS"
BAP is provided "AS IS" without warranties of any kind, express or implied.
We do not guarantee:
- Uninterrupted service
- Error-free operation
- Data loss prevention
- Fitness for any purpose
Not Liable for Bugs or Errors
We are not liable for any damages caused by:
- Software bugs or errors
- Service interruptions
- Data loss
- Application errors
- Security vulnerabilities
- Third-party service failures
Acceptable Use
You May
- Use BAP for personal digital document/message management
- Upload documents you own or have rights to
- Configure recipients and thresholds
- Use the service as designed
You May Not
- Use for illegal purposes
- Attempt to circumvent security
- Attack or abuse the service
- Reverse engineer the software
- Upload malicious content
- Impersonate others
- Resell the service
Account Responsibilities
Account Security
You are responsible for:
- Maintaining password confidentiality
- All activities under your account
- Notifying us of unauthorized use
Account Requirements
- Valid email address
- Strong password (minimum 12 characters)
- Accurate information
Communications Consent
SMS and Messaging
By providing a phone number — whether your own or on behalf of a designated recipient (Survivor) — you consent to receive transactional messages from BAP, including:
- One-time passcodes (OTP) for identity verification
- Liveness check reminders and alerts
- Will transfer notifications when a transfer is triggered
- Security alerts related to your account
Messages are sent via SMS, WhatsApp, Telegram, or email depending on the notification channel you configure. Message and data rates may apply. Message frequency depends on your liveness check settings and account activity.
Opting Out
You may opt out of SMS notifications at any time by:
- Replying STOP to any SMS message from BAP
- Removing SMS as a notification channel in your dashboard settings
- Contacting support at support@baprotocol.com
Important: Opting out of SMS may prevent delivery of critical security notifications, including one-time passcodes and will transfer alerts. BAP is not liable for missed notifications resulting from your opt-out.
Recipient Consent
If you designate a Survivor and provide their phone number, you represent that you have obtained their consent to receive messages from BAP on your behalf. You are responsible for informing your Survivors that they may receive security-related messages.
Third-Party Messaging Providers
SMS messages are delivered through Twilio. WhatsApp messages are delivered through Meta's Cloud API. These providers have their own terms of service and privacy policies. BAP is not responsible for delivery failures caused by third-party providers, carrier filtering, or recipient device settings.
Limitation of Liability
⚠️ Strong Liability Limitations
To the maximum extent permitted by law, BAP and its operators are NOT liable for:
- Direct damages arising from use of the service
- Indirect damages including loss of profits, data, or business opportunities
- Incidental damages including costs of substitute services
- Special damages for any reason whatsoever
- Consequential damages resulting from the use or inability to use the service
- Punitive damages regardless of the cause
Specifically, we are NOT liable for:

Liability Cap
Our total liability is limited to the lesser of:
- The amount you paid for the service in the 12 months preceding the claim, OR
- $0 if you used the free tier
Assumption of Risk
By using BAP, you explicitly acknowledge and assume all risks, including:
- Cryptographic key loss is possible
- SSS share loss is possible
- Data may become unrecoverable
- Recipients may not act on delivered instructions
- Documents may not have legal validity in your jurisdiction
- Service may be interrupted at any time
Indemnification
You agree to indemnify, defend, and hold harmless BAP and its operators from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your documents, files, or content
- Any instructions or information you provide to recipients
- Your violation of these Terms
- Your violation of any third-party rights
- Any claim that your documents constitute a valid legal will
Intellectual Property
Our Rights
BAP and its content are owned by Burning Ash Protocol.
Your Rights
You retain ownership of documents and files you upload.
Restrictions
- No copying of software
- No redistribution
- No derivative works
Third-Party Services
We use third parties for:
- Cloud hosting (AWS)
- Storage providers (AWS S3)
- Notification services (SMTP providers, Twilio, Meta/WhatsApp, Telegram)
- Analytics
We are not responsible for third-party service failures or practices.
Termination
By You
Delete your account anytime via the dashboard or contact support.
By Us
We may suspend or terminate accounts for:
- Violation of these Terms
- Illegal activity
- Non-payment (if applicable)
- Prolonged inactivity
Effect of Termination
- Access to service ends
- Data deleted within 30 days
- No refund (if applicable)
Modifications
We may modify these Terms. Changes will be posted with updated date. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by applicable law. Any disputes will be resolved in appropriate courts.
Dispute Resolution

Before legal action, contact us to resolve disputes.
Arbitration
If required, disputes may be submitted to binding arbitration.
Severability
If any provision is found unenforceable, the remaining provisions continue in effect.
Entire Agreement
These Terms constitute the entire agreement between you and BAP.
