End User License Agreement

Acceptance of Terms
By accessing or using Burning Ash Protocol ("BAP", "Service"), operated by TripleVision LLC, available at www.baprotocol.com, you ("User", "you") agree to be bound by this End User License Agreement ("EULA"). If you do not agree to all terms, do not use the Service.
License Grant
Subject to your compliance with this EULA, Burning Ash Protocol grants you a limited, non-exclusive, non-transferable, non-sublicensable license to:
- Access and use the BAP Service for its intended purpose of digital notification and file delivery
- Create and manage your account
- Upload, encrypt, and configure delivery of documents and messages
- Designate recipients for delivery
Use Restrictions
You may NOT:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Copy, modify, or create derivative works of the Service
- Sell, resell, or exploit the Service for commercial purposes without authorization
- Upload malicious code, viruses, or harmful content
- Impersonate any person or entity
- Use the Service to deliver content that infringes on third-party rights
- Attempt to bypass or circumvent any security measures
- Abuse, harass, or threaten others through the Service
Intellectual Property
BAP Rights
The Service, including all software, algorithms, designs, documentation, and content, is owned by Burning Ash Protocol and is protected by copyright, trademark, and other intellectual property laws.
User Content
You retain ownership of all documents, files, messages, and content you upload to the Service ("User Content"). By uploading User Content, you grant BAP a limited license to store, encrypt, and deliver that content as configured by you.

Not a Legal Will Service
BAP is a digital notification and file delivery system — NOT a legal will service.
Many countries and jurisdictions do NOT legally recognize digital wills. BAP does NOT produce legally binding wills. We are a messaging and file delivery platform — not a legal service.
Users must ensure the validity of any legal documents by consulting qualified legal professionals in their jurisdiction.
No Guarantee of Delivery or Action
BAP does NOT guarantee that:
- Notifications will be delivered
- Recipients will receive or act upon delivered content
- Documents will have any legal effect
- Service will be uninterrupted or error-free
No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
BAP DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- TITLE
- QUIET ENJOYMENT
- ACCURACY OF INFORMATION
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM OR RELATED TO THIS EULA OR THE SERVICE, INCLUDING:
- Direct, indirect, incidental, or consequential damages
- Special, incidental, or punitive damages
- Damages for loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from service interruption, data loss, or delivery failure
- Damages resulting from recipient actions or inactions
- Damages resulting from legal validity (or lack thereof) of any documents
THIS LIMITATION APPLIES EVEN IF BAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Liability Cap
Total liability shall not exceed the amount paid by you (if any) in the 12 months preceding the claim, or $0 if you used the free tier.
Indemnification
You agree to indemnify, defend, and hold harmless BAP and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your User Content
- Your violation of this EULA
- Your violation of any third-party rights
- Any claim that your User Content infringes on third-party rights
Privacy
Your use of the Service is subject to our Privacy Policy, available at www.baprotocol.com/docs/legal/privacy-policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
Data Security
BAP uses industry-standard encryption (AES-256-GCM) to protect your data. However, you acknowledge that:
- No system is completely secure
- Encryption keys can be lost and data may become unrecoverable
- We cannot guarantee absolute security
Service Availability
BAP reserves the right to:
- Modify or discontinue the Service at any time
- Restrict access to the Service for maintenance or updates
- Limit storage capacity or bandwidth usage
Termination
Termination by You
You may stop using the Service at any time. You may delete your account through the dashboard or by contacting support.
Termination by BAP
BAP may suspend or terminate your access to the Service at any time, with or without cause, including for:
- Violation of this EULA
- Illegal activity
- Non-payment (if applicable)
- Prolonged inactivity
Effect of Termination
Upon termination:
- Your license to use the Service ends
- Your data may be deleted within 30 days
- All provisions that should survive termination will remain in effect
Severability
If any provision of this EULA is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement
This EULA, together with the Privacy Policy and Terms of Service, constitutes the entire agreement between you and BAP regarding the Service.
Governing Law
This EULA is governed by applicable law. Any disputes shall be resolved in appropriate courts.
Changes to This EULA
BAP may update this EULA at any time. Continued use of the Service after changes constitutes acceptance of the new terms.
